Terms and conditions of sale

1. Purpose

The present conditions define the rights and obligations of the parties in the context of the online sale of Jacques Marie Mage frames offered on our site. They govern all the steps involved in placing and tracking an order.

2. Products

The products sold are Jacques Marie Mage brand frames. The essential characteristics of the frames are presented on our website. The photographs and descriptions are as accurate as possible, but cannot guarantee a perfect match with the product delivered, particularly with regard to colors.

3. Product availability

Product offers are subject to availability. In the event of unavailability after the order has been placed, we will inform you as soon as possible and reimburse your order within 14 days.

4. Awards

The prices of the frames are indicated in euros, all taxes included (TTC), excluding delivery costs. The total amount, including delivery costs, is indicated before the final validation of the order. We reserve the right to modify our prices at any time, but the products will be invoiced on the basis of the rates in force at the time the order is validated.

5. Payment

Payment for frames is made online, by credit card or any other secure payment method available on our site. The order will only be validated once payment has been confirmed.

6. Delivery

We deliver throughout the European Union. Delivery costs are specified when the order is confirmed. Frames are shipped by UPS to the address indicated by the customer when ordering. Delivery times may vary according to destination and are given as an indication only. In the event of late delivery, we will inform you as soon as possible.

 7. Right of withdrawal and return

In accordance with current European regulations, you have a period of 14 days from receipt of the frames to exercise your right of withdrawal without having to give any reason. To exercise this right, you must notify us in writing at info@moitzheim.lu of your decision to withdraw before the deadline expires.

Frames must be returned in their original condition, unworn and undamaged, and accompanied by all accessories (case, microfiber, certificate, etc.). They must also be returned in their original packaging.

Return costs: Return shipping costs are at the customer's expense, except in the case of a defective product or delivery error on our part.

Condition of returned products: If, upon receipt of the returned product, we find that the frame has been visibly worn (traces of wear, scratches, deformation) or that it has been damaged (breakage, damage), we reserve the right to :

• Refuse the return and send the frame back to you at your expense;
• Or, apply a discount to the refund depending on the condition of the returned product. This discount can be up to 50% of the price indicated at the time of the customer's purchase, depending on the extent of the damage or wear.

We will inform you by email as soon as possible of the condition of the returned product and the action taken (refusal or discount).

8. Refund

In the event of compliant withdrawal, we will refund the total amount of the order, including standard delivery charges (with the exception of additional charges for express delivery) within 14 days of receipt of the returned frames or proof of shipment. Refunds will be made by the same means of payment used to place the order.

9. Warranty

Jacques Marie Mage frames are covered by the legal guarantee of conformity (articles L.217-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). In the event of a defect or fault, you can return the frames to us, with proof of purchase, for repair, exchange or reimbursement.

10. Liability

We undertake to make every effort to guarantee the best quality of our products and services. However, we cannot be held liable in the event of non-performance or improper performance of the contract due to force majeure, an unforeseeable and insurmountable act by a third party, or fault on your part.

11. Personal data

The information collected at the time of ordering is processed in compliance with current legislation on the protection of personal data (RGPD). You have the right to access, rectify and delete your personal data, which you can exercise at any time by contacting us at. info@moitzheim.lu .

12. Modification of general terms and conditions

We reserve the right to modify these terms and conditions at any time. The applicable conditions will be those in force at the time of the order.

13. Applicable law and disputes

These terms and conditions are governed by Luxembourg law. In the event of a dispute, we invite you to contact us in order to find an amicable solution. Failing this, any dispute will be referred to the competent courts of the Grand Duchy of Luxembourg.
