1. Purpose
These terms and conditions set forth the rights and obligations of the parties in connection with the online sale ofJacques Marie Mageeyeglass frames offered on our website. They govern all steps necessary for placing and tracking an order.
2. Products
The products sold are frames from theJacques Marie Mage brand. The key features of the frames are listed on our website. The photographs and descriptions are as accurate as possible, but we cannot guarantee that they will match the delivered product exactly, particularly with regard to colors.
3. Product availability
Product offers are subject to availability. In the event of unavailability after the order has been placed, we will inform you as soon as possible and reimburse your order within 14 days.
4. Awards
The prices of the frames are indicated in euros, all taxes included (TTC), excluding delivery costs. The total amount, including delivery costs, is indicated before the final validation of the order. We reserve the right to modify our prices at any time, but the products will be invoiced on the basis of the rates in force at the time the order is validated.
5. Payment
Payment for frames is made online, by credit card or any other secure payment method available on our site. The order will only be validated once payment has been confirmed.
6. Delivery
We deliver throughout the European Union. Delivery costs are specified when the order is confirmed. Frames are shipped by UPS to the address indicated by the customer when ordering. Delivery times may vary according to destination and are given as an indication only. In the event of late delivery, we will inform you as soon as possible.
7. Right of withdrawal and return
In accordance with current European regulations, you have 14 days from the date of receipt of the frames to exercise your right of withdrawal without having to provide a reason. To exercise this right, you must notify us in writing atinfo@moitzheim.luof your decision to withdraw before the deadline expires.
Frames must be returned in their original condition, unworn and undamaged, and accompanied by all accessories (case, microfiber, certificate, etc.). They must also be returned in their original packaging.
Return shipping costs: The customer is responsible for return shipping costs, unless the product is defective or we made a mistake in the delivery.
Condition of Returned Products: If, upon receipt of the returned product, we find that the frames have clearly been worn (signs of wear, scratches, warping) or have been damaged (broken, damaged), we reserve the right to:
- Refuse the returnand ship the frame back to you at your expense;
- Alternatively,apply a discountto the refund based on the condition of the returned product; this discount may be up to 50% of the price paid by the customer at the time of purchase, depending on the extent of the damage or wear and tear.
We will inform you by email as soon as possible of the condition of the returned product and the action taken (refusal or discount).
8. Refund
In the event of compliant withdrawal, we will refund the total amount of the order, including standard delivery charges (with the exception of additional charges for express delivery) within 14 days of receipt of the returned frames or proof of shipment. Refunds will be made by the same means of payment used to place the order.
9. Warranty
Jacques Marie Mage frames are covered by the legal guarantee of conformity (articles L.217-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). In the event of a defect or fault, you can return the frames to us, with proof of purchase, for repair, exchange or reimbursement.
10. Liability
We undertake to make every effort to guarantee the best quality of our products and services. However, we cannot be held liable in the event of non-performance or improper performance of the contract due to force majeure, an unforeseeable and insurmountable act by a third party, or fault on your part.
11. Personal data
The information collected when you place an order is processed in accordance with applicable data protection laws (GDPR). You have the right to access, correct, and delete your personal data, which you may exercise at any time by contacting us atinfo@moitzheim.lu.
12. Modification of general terms and conditions
We reserve the right to modify these terms and conditions at any time. The applicable conditions will be those in force at the time of the order.
13. Applicable law and disputes
These terms and conditions are governed by Luxembourg law. In the event of a dispute, we invite you to contact us in order to find an amicable solution. Failing this, any dispute will be referred to the competent courts of the Grand Duchy of Luxembourg.
